Consequent to the representations made by our Chamber to TNEB, Chairman of the Tamil Nadu Electricity Board, the Chairman of TNEB has granted time upto
31st May, 2010 for the payment of penal charges levied on violation of evening peak hour restriction.
Members may be aware that a batch of Writ Petitions came before Justice Mr V Dhanapalan at Madras High Court on Tuesday the 18th May, in connection
with imposition of penal charges in respect of violation of evening peak hours. The High Court has classified the HT consumers into three categories
based on the notice served by the concerned Superintending Engineers of respective circles. As far as the first category is concerned, the Court held
that the consumers have to pay 30% of the demand notice within a week’s time and go for appeal within a period of two weeks. In the case of
categories 2 and 3, he quashed the demand notice issued by the authorities of Electricity Board and directed to issue a fresh notice and after hearing
the consumers the authorities concerned should pass an Order.
Consequent to TNEB Chairman’s circular, members may now take time upto 31.5.2010. Meanwhile, an application has been filed before TNERC seeking
orders to pay the penal charges in 10 instalments. A petition is also being filed before the CERC appealing against the TNERC orders which held that the
Penal charges have to be paid. Meanwhile another association has obtained stay against the TNERC orders.
Members are therefore advised that there won’t be any disconnection for the non-payment of penal charges on 20th May, 2010.
